OnCue Privacy Policy

Kohler has created this privacy statement in order to show our firm commitment to your privacy. The following discloses our information gathering and sharing practices for OnCue Application and related services ("OnCue").

1. Personal Information Collection

The OnCue services require us to collect first and last name, telephone number, email address, and home or business mailing address when you access certain areas of the OnCue services that require registration services, or if you require more information about the OnCue services. Use of the service will also require you to setup an account protected by a unique username and password.

At other times, Kohler may collect information that we cannot use to directly identify you. For example, we may collect non-personal information such as Wi-Fi, router IP addresses, and unique device identifiers when you use our services. We may also generate analytical data, such as customer energy use data (CEUD) that may be aggregated with other information, including personally identifiable information, and that analytical data may be linked directly back to you.

2. How Kohler Collects Information

Kohler may use any number of tools to collect information about you, your computer access points, and the web browser that you use to connect to OnCue. For example, your device and service settings may allow us to automatically collect information from your smart device and power generation products. We will use this information only for the services that you have purchased. We may also use other analytical or tracking technologies to personalize your interactions with OnCue. Kohler may collect information from your web browser each time you visit OnCue. We may collect information about the pages that you visit and the time spent on each web page or area of the OnCue service. This information may include your Internet Protocol ("IP") address, the type of browser, and the time that you opened OnCue.

3. Our Use and Disclosure of Your Information

At times, we may use the services of third-party companies to provide certain services to you, for example, our distributors, dealers and physical maintenance and support vendors. Kohler may share your personal information with these vendors as appropriate. We do not share personally identifiable information with outside third parties without your consent, except to the extent necessary to complete your request for products and services offered through the OnCue services.

We may use your personal information to contact you via mail, e-mail, or telephone in order to give you updates regarding the services and products that you have purchased in connection with the OnCue services. We use return e-mail addresses to answer the e-mail we receive from you. Kohler will not share your e-mail address with outside third parties for their direct marketing purposes. We may use your IP address to help protect Kohler and our vendors from fraud.

Additional uses of your non-personal and personal information will allow us to tailor products and services specific to your needs. The information will help us organize and manage our relationship with you, conduct business, provide customer support, perform functions that are described to you at the time of collection or such data.

Kohler may disclose your personal information as is necessary to: (a) comply with a subpoena or court order; (b) cooperate with law enforcement or other government agencies; (c) establish or exercise our legal rights; (d) protect the property or safety of our company and employees, contractors, vendors, suppliers, and customers; (e) defend against legal claims; (f) help with internal and external investigations; or (g) as otherwise required by law or permitted by law. We may disclose your personal information in connection with the sale or merger of Kohler or any transaction that involves the sale or assignment of some or all of our assets.

4. Data Storage and Security


Kohler makes reasonable efforts to ensure that our vendors have implemented physical, electronic, and procedural security measures to assist with safeguarding your personal information, and to help protect against unauthorized access and disclosure. Only our authorized personnel who perform legitimate business functions for Kohler are authorized to access your personal information. Notwithstanding our efforts, the Internet and online services have inherent security risks. Kohler cannot promise, and you should not expect, that your personal information, and other communications will always remain secure. You should take care with regard to how you handle and disclose your personal information or any username or password that you are required to use to access services on OnCue.

5. Children and Data Collection

 

OnCue is a general audience application. Kohler does not direct its Web site content toward children under 13 years old. We do not knowingly collect personal information from children. If Kohler becomes aware that a child has provided us with personal information without parental consent, Kohler will delete that information from our databases.If you have questions about personal information related to a child, please email us at privacy@kohler.com.

 

6. Privacy Choice

 

Kohler will not share any personal information about you with outside third parties for their direct marketing purposes, unless you agree otherwise as authorized by your prior affirmative consent.

7. How You May Access and Change the Information that Kohler Collects

The first time that you register with the OnCue service, you will be required to provide profile information. You will always have access to such information and the ability to edit, update or remove such information from our records. Some device-related data may continue to be logged and monitored by our service even after you elect to remove personally identifiable information or discontinue the service. Kohler may offer you the opportunity to subscribe to and receive information about other products and services. You may also change your initial choices by contacting customer service via e-mail at privacy@kohler.com.

Kohler may update this privacy policy from time to time, and you should take the time to review it each time that you use the OnCue services.
